HireHop Website Terms and Conditions of Use

1 Scope

1.1 The following contains the General Terms and Conditions of Use ("Terms") for the use of online services provided by HireHop Software Limited, being a UK registered company (hereafter "HireHop" or "We") and covers rules and agreements of transactions and disputes between you (the "User") and HireHop.

2 Service

2.1 HireHop provides an online platform ("the Service") via a website ("the Website") that enables Users to conclude a variety of rental and sales agreements ("Rental Agreements") between themselves and prospective clients. Such agreements will be between a User selling or renting out goods or services ("the Hire Company") to another User buying or hiring those goods or services ("the Rental Customer"). Nothing in this agreement shall create or be deemed to create a partnership, a joint venture, a relationship in principal, agent, employer and/or employee between HireHop and a User and/or Rental Customer.

2.2 HireHop does not offer any rental services. The site is an online marketplace only, designed for the unique purpose of putting people who want to rent items in touch with people who have items to rent. We never intervene in the transaction between the Rental Customer and the Hire Company, or have any liability or governance over any such transaction. HireHop cannot thus be considered party to any Rental Agreement between members and/or Users of the Site.

HireHop exercises no control over the quality, safety or legality of any items listed, or over the truthfulness or accuracy of the Rental Listings, or over the ability of the Hire Company to rent the items listed or over the ability of the Rental Customer to rent or pay for the rental of any items. We do not guarantee that the Parties will complete any or all terms of the transaction. HireHop is and will not be party to any Rental Agreement for the Service and will have no liabilities in any form to such.

Any security deposits or guarantees required by the Hire Company in whatever form, remains the responsibility of the Rental Customer and the Hire Company. HireHop is not responsible for the collection, retention, or refunding of any security deposit, for the control of the exact identity of the Hire Company and/or the Rental Customer, or for collecting money owed by the Rental Customer to the Hire Company or by the Hire Company to the Rental Customer.

2.3 All information you provide to us is stored on our secure servers. Where the User has chosen a password which enables themselves to access certain parts of our site, they are responsible for keeping this password confidential. We ask that they not to share a password with anyone.

Unfortunately, the transmission of information via the internet is not completely secure. Although We will do our best to protect the User's personal data, we cannot guarantee the security of the User's data transmitted to our site; any transmission is at the User's own risk. Once We have received the User's information, We will use strict procedures and security features to try to prevent unauthorised access.

3 Information Uses

3.1 We may use information the User supplies to HireHop to display listings within the Website and search results embeded into third party websites. The User gives HireHop permission to waiver all copyright rights associated with any stock images they add to the Website.

3.2 We may also permit selected third parties to use the User's data to provide them with information about goods and services which may be of interest to them and We or they may contact them about these by post, telephone or by electronic means. If the User does not want HireHop to use their data, or to pass their details on to third parties for marketing purposes etc., please tick the relevant box when signing up or deselect the option in “My HireHop”.

4 Registration / User Account

4.1 Use of the Service is in principle possible without registration. Registration is only required to use certain features of the Service or to register as a Hire Company.

4.2 Registration and the creation of user accounts are free of charge. HireHop reserve the right to refuse service to anyone, including minors under the age of 18.

4.3 The User is required to disclose true and complete information during registration. A change in the personal data of the User after registration shall be updated in the account settings immediately or - if this is not possible – HireHop shall be informed immediately of the changes. By using the Service or by submitting the registration form, the User agrees to comply with all the Terms and confirms, that they are aged 18 years or over and are entitled to use the Service in accordance with the Terms.

4.4 HireHop reserves the right to decline any User´s registration or suspend it without giving reasons.

4.5 The User must keep their Password secret to protect the account from access by unauthorized third parties. Where the User has lost or forgotten a Password or suspects that their credentials are being used by a third party, the User shall inform HireHop immediately (see Contact us page).

4.6 HireHop has the right immediately to block a User´s account and terminate this agreement at its own discretion. This includes.

a) if false statements were made by the User when registering.
b) in the case of loss or suspicion of misuse of the Access data by any person.
c) if the User has breached any of the Terms.
d) if any serious act by the User gives HireHop reasonable grounds for so doing.
e) if HireHop are ordered or asked to do so by a governing authority or court of law.

4.7 The user will be deemed as in breach if they use listings, locations or their account for spamming purposes. This includes fake addresses, duplicate item listings, keyword spamming, etc. Hirehop can remove all listings and/or locations in breach and suspend accounts as HireHop deems.

4.8 HireHop shall not be held liable for any losses to a User due to their account being blocked or suspended.

4.9 In the event that a User account is blocked or suspended by HireHop, the User concerned is barred from re-registering and opening a User account on the website without the prior and express written consent from HireHop.

4.10 The user agrees that they are authorised by the company and/or person they posting information about to submit information on their behalf onto the HireHop website.

5 Conclusion of Rental Agreements

5.1 The rental customer can either directly contact the Hire Company via the displayed contact details of the Hire Company or place a non-binding enquiry via a contact form to enquire about a rental agreement with the Hire Company for renting a particular rental item. HireHop will transmit the data in the contact form to the Hire Company.
Settlement and performance of the Rental Agreement is concluded in each case solely between the Hire Company and the Rental Customer.

5.2 The details of the rented items in the listings on the website come from the Hire Companies. HireHop does not assume liability for the accuracy and timeliness of this information.

5.3 HireHop gives no guarantee to the User that other Users of the Service will not use the Service with intent to defraud. In particular, HireHop does not accept any liability arising as a result of a User registering under a false identity. HireHop recommends that all Users verify the identity of their contracting partners prior to the exchange of goods or services or money or financial information.

6 Use of personal information

6.1 Contact details that are disclosed through use of the Service, or that become known within the framework of the use of the Service, may be used by the contracting parties solely for transacting Rental Agreements. In particular, all Users are forbidden from using such data for advertising purposes or for sending any unsolicited email, fax or letter or for making contact by telephone or otherwise.

6.2 All information the User puts onto the HireHop website will be and remain the property of HireHop.

7 Termination

7.1 The User may terminate this User Agreement at any time by notifying HireHop in writing, but agrees not to use or register with the Website. Any such notice shall be deemed as served if a response is given by HireHop or service is recorded by a third party.

7.2 HireHop can cancel this agreement with the User at any time on two weeks written notice sent by post or email to the relevant address registered by the User. HireHop can also cancel this agreement at any time without notice on breach by the User of this agreement.

8 Liability

8.1 HireHop does not warrant that the use of the Service will be uninterrupted or error-free.

8.2 HireHop shall have no liability for any losses or damages which may be suffered by a User (or any person claiming under or through a User), whether the same are suffered directly or indirectly or are immediate or consequential, which fall within the following categories:

a) special damage even though HireHop was aware of the circumstances in which such special damage could arise;

b) loss of profits, revenue, anticipated savings, business opportunity or goodwill;

c) loss of, or damage to, data;

d) loss of contract;

e) reduction in goodwill;

f) for any other direct or indirect or consequential loss however arising, due to any use of or defect in the Service (including any virus) even if such loss was reasonably foreseeable or HireHop had been advised of the possibility by the User or any other party.

9 Indemnity

9.1 The User indemnifies and holds harmless HireHop against all claims, damages, costs and expenses of whatever nature (including costs on an indemnity basis) which HireHop may incur or which may be awarded against HireHop and which arise out of the use of the Service by or with the permission of the User or out of a breach of this agreement. For the avoidance of doubt this indemnity includes, without limitation, costs and expenses reasonably incurred in responding to and dealing with claims made irrespective of whether proceedings have been commenced, and claims relating to the services or goods offered by a User through the Website, ratings placed by one User in respect of another User, or as a result of the illegal offer or rental of an item.

9.2 The User is bound, in the event of a claim against HireHop, to provide HireHop immediately, truthfully and completely with all information required by HireHop to examine the claim and to prepare a defence against the claim.

10 No Set-off

10.1 A User shall have no right of set-off in relation to any sums due to HireHop or any claims or liabilities the User has or claims to have against HireHop.

11 Governing Law and Dispute Resolution

11.1 This agreement shall be governed by and construed in accordance with UK law and HireHop and the User hereby submit to the exclusive jurisdiction of the United Kingdom courts.

12 Amendments to the General Terms of Use

12.1 HireHop reserves the right to amend these Terms at any time and will publish any new Terms on the Website. It is the User's responsibility to check for any changes (a date of publication is mentioned at the start of the Agreement). HireHop will endeavour to send the User a link to new Terms by email.

12.2 The revised Terms are deemed accepted if the User does not object within 14 days following the sending of the email. Any objection must be in writing and will have the effect of immediately terminating this agreement (see section 7).

13 Severability

13.1 Any condition deemed invalid will not affect other conditions.

14 Third Party Cookie Privacy Policy

14.1 Third party vendors use cookies to serve ads based on a user's prior visits to HireHop. Users who register and list their business with HireHop must agree to allow the use of these cookies.

14.2 Use of the DoubleClick cookie enables advertisers and their partners to serve ads to users based on their visit to HireHop and/or other sites on the Internet. Users may opt out of the use of the DoubleClick cookie for interest-based advertising by not loging in.
